Terms & Conditions

1. Introduction

These terms and conditions (“the Terms”) govern every contract made between Quattro Producción Digital, S.L. (“Quattro”) for the supply of goods and services by Quattro to any person, firm or company (“the Client”).
1.2/ The Terms prevail over any written Terms and conditions of the Client.
1.3/ Any variation to the Terms must be agreed in writing by a Director of Quattro.
1.4/ All contracts between Quattro and the Client will be governed by Spanish Law and the parties agree to submit to the exclusive jurisdiction of the Spanish Courts.

2. Price and payment

2.1/ The Client will pay to Quattro the price set out in Quattro’s current price list, which Quattro can change at any time, plus I.V.A.
2.2/ If the Client does not have an account with Quattro, work must be paid for on collection of the completed job. Payment may be made by cash or cheque.
2.3/ Quattro reserves the right not to provide credit facilities without disclosing a reason. Clients should be aware that account applications will be credit checked.
2.4/ If the Client has an account with Quattro, the Client will pay invoices within 30 days of the date of the invoice.
2.5/ The Client will pay to Quattro any expenses incurred by Quattro in connection with the recovery of monies outstanding (including legal costs on an indemnity basis).

3. Orders

3.1/ Orders must be given in writing and signed by a person authorised to do so by the Client.
3.2/ If, not withstanding clause
3.1/ Quattro accepts a verbal order from the Client then Quattro will not be responsible for any mistakes (made by either party) arising from the verbal order.

4. Quotations

4.1/ All quotations given by Quattro will be valid for 30 days from the date of the quotation.
4.2/ If the Client’s order differs from the specification on which the quotation was based, then Quattro reserves the right to vary the quotation (including the price).

5. Service times and opening times

5.1/ Service times which are quoted are target times only and Quattro reserves the right to vary service times and accepts no liability for failure to comply with quoted service times.

6. Deliveries

6.1/ Quattro’s courier service to Barcelona from 6,60€ .
6.2/ Whilst Quattro will make every effort to collect and deliver as quickly as possible, it will not be liable for any losses arising from delays in delivery or collection.

7. Judge and run

7.1/ Quattro will, if requested, judge tests and run balances for the Client but will do so solely at the Client’s own risk.
7.2/ Quattro will not accept any liability for any loss or damage sustained by the Client as a result of “judge and run” whether caused by the negligence of Quattro, its employees or agents or otherwise.

8. Negative storage

8.1/ Negatives held at Quattro pending a print order will be returned on production of the prints. If no print order is produced negatives will be held for up to 6 months. Any negatives not collected after 6 months will be disposed of by Quattro.

9. Data storage

9.1/ Digital data arising from retouching and manipulation work or other such areas are stored by Quattro on the understanding that Quattro are not responsible for the future integrity of that data, or of any failure to retrieve data from Quattro’s storage archive.

10. Uncollected goods

10.1/ If any items or materials (other than unprocessed film), deposited with Quattro by the Client are not collected by the Client within 12 months of completion of the work undertaken by Quattro, then Quattro may dispose of or destroy such items or materials.

11. Copyright and moral rights

11.1/ Quattro will claim no copyright in material submitted to Quattro by virtue of work undertaken by Quattro on behalf of the Client.
11.2/ The Client warrants that the Client owns or controls all rights or has obtained all copyright, moral rights and similar permissions, consents and waivers as are now or hereafter required for all copying, processing and manipulation to be undertaken and the Client hereby irrevocably authorises Quattro to do all such copying, processing or manipulation as is necessary in performing or ancillary to the services requested by the Client.
11.3/ The Client warrants that all film and negatives deposited with Quattro do not contain any material which is defamatory, blasphemous or obscene.

12. Liability

12.1/ The Client must notify Quattro in writing of any claim concerning any invoice of Quattro’s within 30 days of the date of the invoice.
Quattro will not be liable in respect of any claim notified after such time.
12.2/ Any film, negatives and/or other materials belonging to the Client or any third party and provided to Quattro by the Client (for storage or otherwise) (“Client Materials”) shall remain at the Client’s risk at all times and the Client shall be responsible for insuring the same at its own expense.
